The supreme court has affirmed the election of Ademola Adeleke as the governor of Osun state.
A five-member panel of the apex court on Tuesday held that the court of appeal correctly reinstated Adeleke as governor.
Justice Emmanuel Agim while delivering judgment held that the court of appeal correctly set aside the decision of the tribunal noting there was no way Gboyega Oyetola could depend on only the information of the back-end server and not look into the voters register which forms a foundation of the electoral process in any polling unit.
The apex court held that the respondent’s findings in the issues of BVAS were that there was overvoting in only 6 polling units which didn’t affect the emergence of Ademola Adeleke as the governor.
The court while dismissing the appeal on Adeleke’s qualifications held that Oyetola’s appeal collapsed for failure to prove his case beyond reasonable doubt as it is not enough to point out issues of certified documents without making findings to back up the claims.
