…admit error in judgment of October 14th, 2021
The Supreme Court of Nigeria has written to Chief Edozie Njoku, admitting there was an error in the judgment of October 14th, 2021.
On October 7th, 2022, Edozie Njoku wrote to the Chief Justice of Nigeria, Kayode Ariwoola, asking for a clarification of the correction made by Justice Mary Ukaego Peter-Odili on May 9th, 2022.
The Supreme Court’s letter dated 19th January, 2023, acknowledged a ‘slip’ in the judgment of October 14th, 2021.
Hajo Sarki Bello esq. the Chief Registrar of the Supreme Court on behalf of the Chief Justice wrote : “what you ought to have done is to bring an application pursuant to Order 8 Rule 16 of the Rules of this Court seeking to correct accidental slip in the judgment.”
The Chief Justice advised Edozie Njoku to file a motion. “Consequent upon the foregoing, you are hereby advised to file the necessary application for same as provided in the Court’s rules.”
Justice Mary Ukaego Peter-Odili’s 5 man panel had held that the removal of an officer of a political party was an internal affair of the Party and therefore not justiceable. However, instead of recognising Edozie Njoku as the Chairman whose removal was not justiceable, it mentioned Victor Oye.
On May 6th, Njoku wrote to the 5 man panel pointing out the error and asked for correction. On the 9th of May, Justice Mary Ukaego Peter-Odili made the correction, replacing Victor Oye’s name with Edozie Njoku.
Victor Oye petitioned the Nigerian Police Force and other security agencies, claiming that Edozie Njoku forged a Supreme Court judgement.
Edozie Njoku was elected during the APGA national convention in Owerri as National Chairman.
