The court of appeal, Abuja, has just thrown out a suit filed by Sly Ezeokenwa/ Victor Oye through their counsel, Onyechi Ikpeazu, a senior advocate of Nigeria (SAN), against the Interlocutory ruling of Justice Madugu of the FCT high court.
The court had, before final judgment, given an order restraining Oye and INEC from parading himself as chairman and being recognised as such by the 2nd defendant.
Oye was also restrained from conducting meetings of APGA, gathering, and convening congresses and conventions.
The judge also ruled against Oye’s objections to the suit on lack of jurisdiction and abuse of the court process.
The Judge ruled that the FCT High Court had jurisdiction as the matter before it was the enforcement of a Supreme Court judgement.
After the ruling by Justice M.A. Madugu, Onyechi Ikpeazu SAN filed a notice of appeal and told the FCT High Court that they had appealed the ruling.
Edozie Njoku’s lawyers brandishing a letter from the FCT High Court registry told the Bwari court that it was a tactic to buy time and frustrate the substantive case as no appeal had been filed by Victor Oye’s lawyers.
Earlier today the matter came up at the Court of Appeal, Abuja. The panel of judges were scandalised that Victor Oye’s lawyers were appealing an Interlocutory ruling in a matter that judgment had already been pronounced.
The judges chided the appellants for unprofessional conduct and even the registrar who scheduled the matter for hearing and subsequently dismissed the appeal for lack of merit and abuse of court process.
